Terms & Conditions

These terms apply to any order, quote or use of instacookie.ca. By placing an order with InstaCookie Inc. ("InstaCookie", "we", "us"), you agree to them.

Quotes & orders

Prices shown on this site are estimates. A final quote is confirmed once we understand your product, quantity, artwork and delivery details. Nothing is produced, and no payment is due, until you approve a digital mock-up.

Artwork & approval

Once you approve a mock-up, that design is locked and production begins. Changes after approval may not be possible, or may incur a rework charge. You confirm that any logo, photo or artwork you send us is either your own or that you have permission to use it — see "Intellectual property" below.

Payment

Orders under $2,000 are paid in full at mock-up approval. Larger orders, live events, and gift packages involving custom merchandise are typically 50% at approval and 50% on or before delivery. Wholesale and enterprise accounts may be offered net-30 terms after a first completed order. All prices are in CAD and exclude HST unless stated otherwise.

Cancellations & refunds

• Before mock-up approval: cancel or change anything at no charge.
• After mock-up approval: production has started. Cancellations are charged for materials and work already committed; quantity can be increased but generally not reduced.
• If what arrives doesn't match the approved mock-up, or arrives damaged, tell us within 48 hours with a photo — we will remake the affected items or issue a credit.
• Because every order is custom-made to your specification, we're unable to offer refunds for change of mind once production has begun.

Delivery

Delivery dates are estimates based on the lead times shown on this site and in your quote. We are not responsible for courier delays outside our control, but we'll help resolve any delivery issue as quickly as possible.

Intellectual property

You retain ownership of any logo, artwork or content you provide us. By sending it to us, you grant InstaCookie permission to reproduce it solely for the purpose of producing your order (and, unless you ask us not to, to photograph the finished product for our own portfolio and marketing). InstaCookie retains ownership of any original design work we create for you unless otherwise agreed in writing.

Allergens & food safety

Our products may contain or be produced in a facility that handles nuts, dairy, eggs, wheat and soy. Full ingredient information is provided on request and printed on packaging where required. See our ordering info page for details. We are not a dedicated allergen-free facility.

Website use

The tools on this site (the budget/plan builder, the price estimator, and the quote cart) provide estimates only and do not constitute a binding quote or contract. A binding order exists once we've confirmed a final quote and you've approved a mock-up.

Limitation of liability

To the extent permitted by law, InstaCookie's liability for any order is limited to the amount paid for that order. We are not liable for indirect or consequential loss (for example, loss of an event's success) arising from a delayed or incorrect order, though we will always work to make it right.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable within it.
